Terms of Service
These Terms of Service ("Terms") are an agreement between Dr. Hines Inc. ("we," "our," "us"), which operates Construction in a Box, and the company that signs up for the Service ("Customer," "you"). They also apply to each person the Customer adds to its account ("User"). By creating an account, starting a trial or using constructioninabox.com and the Construction in a Box app (together, the "Service"), you agree to these Terms and our Privacy Policy. If you are agreeing for a company, you confirm you have authority to do so.
1. The Service
Construction in a Box is software for contractors: leads, measurements, estimates, invoices, e-signatures, payment links, scheduling, crew and subcontractor management, job costing, messaging, translation, team location on shift, hail reports and related tools. Features vary by plan. We may improve and change the Service over time.
2. Accounts and Users
The Customer is responsible for its account and for the Users it adds, including what each User can see and do. Keep sign-in links and codes private. Tell us right away at support@constructioninabox.com if you think your account has been used without permission.
3. Plans, trials and billing
3.1 Trial. New companies may try the Service free for 14 days. No card is needed to start.
3.2 Billing. Paid plans are billed monthly or yearly in advance through Stripe at the price shown on our pricing page when you subscribe. Add-ons such as business texting are billed as described on that page.
3.3 No contracts, cancel anytime. You can cancel in Settings at any time. Your plan keeps working until the end of the period you already paid for. We do not refund partial periods except where required by law.
3.4 Price changes. We will give you at least 30 days notice before a price change takes effect on your account.
3.5 Taxes. Prices do not include taxes. You are responsible for applicable taxes.
4. Your data
4.1 You own your data. Everything your company enters into the Service belongs to you. You give us permission to store, process and display it only as needed to provide and support the Service.
4.2 Export. You can download your data at any time, including after you cancel, for a reasonable period before it is deleted.
4.3 Your responsibilities. You are responsible for the accuracy of what you enter and send, including prices, measurements, estimates, invoices, contracts and change orders, and for having the right to enter information about your customers, employees and subcontractors.
5. Your legal responsibilities
You agree to use the Service in compliance with the law, including:
- Texting and calling. Get the consent required by law (including the Telephone Consumer Protection Act) before texting or calling anyone through the Service, honor opt-outs, and do not send spam.
- Email. Follow anti-spam laws when sending marketing email.
- Recording visits. Get the agreement of everyone in a conversation before recording it, as some states require.
- Team location. Tell your team about location tracking, get their agreement, and use it only during work shifts and as the law allows.
- Licensing and contracts. Hold any contractor licenses, permits and insurance your work requires, and use contract terms that fit your state.
6. AI drafts and translation
AI features create drafts and suggestions. Review everything before you send it or rely on it. Translations between English and Spanish are made by machine and can contain mistakes. Check anything important, such as dates, prices and addresses, with the person you are messaging.
7. Estimates, solar figures and hail data
Calculations in the Service, including measurements, material counts, solar production, savings and payback, are estimates based on what you enter and are not a guarantee. Solar figures do not include tax credits, and we do not give tax, legal or financial advice. Hail reports come from the NOAA Storm Prediction Center, are preliminary, and may change or contain errors.
8. Payments between you and your customers
Payments your customers make to you run through your own Stripe account under Stripe's terms. We are not a party to the agreements or payments between you and your customers and are not responsible for disputes about work, payment or refunds.
9. Acceptable use
Do not use the Service to break the law, send spam or harassing messages, impersonate anyone, upload malicious code, try to access other companies' data, or interfere with the Service. We may suspend accounts that put the Service or other people at risk.
10. Our intellectual property
The Service, including its software, design and content, belongs to Dr. Hines Inc. You may use it only as these Terms allow. Please do not copy, resell or reverse-engineer it.
11. Disclaimers
The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted or error-free. Wireless carriers are not liable for delayed or undelivered messages.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
13. Indemnity
You agree to defend and hold us harmless from claims arising from your use of the Service, your data, your messages, or your work for your customers, except to the extent caused by our own breach of these Terms.
14. Termination
You may stop using the Service at any time. We may suspend or end access for nonpayment or a serious breach of these Terms. After termination you may download your data for a reasonable period, after which it will be deleted.
15. Governing law
These Terms are governed by the laws of the State of Oklahoma. Any dispute will be handled in the state or federal courts located in Tulsa County, Oklahoma.
